Harrington v. Purdue shut the door on nonconsensual third-party releases and forced every mass-tort strategist to rethink the bankruptcy route. The 2023 amendment to Rule 702 told federal judges, in plain terms, to start gatekeeping expert testimony again, and some circuits listened while others carried on as before. Each of these is a case that redraws a map someone was navigating by.\n\nWe also watch the courts themselves as institutions, because venue is strategy. It also keeps us honest about the firms we list, because practice claims are easier to evaluate when you know what the underlying work involves.\n\nExpect a handful of pieces here each quarter rather than a daily feed. Appellate law generates noise on a schedule; consequences arrive irregularly. When the Supreme Court term produces something that will follow litigants around for a decade, or when a new forum starts pulling cases away from an old one, this category is where we will take it apart, docket numbers included.\n\nA note on what we deliberately leave out of the courts and cases file. We skip most circuit splits until the Supreme Court takes one, because covering every split is a full-time job that produces almost no practical guidance. We skip celebrity trials entirely; other outlets have them covered beyond any conceivable need. And we skip predictions about how judges will vote, a genre with a memory conveniently shorter than its confidence. What remains is smaller and slower: decided cases, functioning or malfunctioning courts, and the specific ways each one changes the work.
