Estate work in Florida splits into two halves: planning documents made while someone is alive, and court proceedings after they die or lose capacity. Luis E. Barreto & Associates, P.A. handles both. The Coral Gables firm has operated since 1998 and takes clients throughout the State of Florida.

The stated practice list covers litigation, appeals, estate planning, trusts, wills, probate administration, guardianship, elder law, probate litigation, guardianship litigation and trust litigation. On the planning side, the firm drafts wills and trusts, reviews documents clients already hold, advises trustees, and prepares reports and tax returns. Elder law work covers Medicaid planning, healthcare planning, asset protection and Social Security matters.

Contested estate matters

The firm represents both plaintiffs and defendants in will contests. The grounds it names are undue influence, lack of capacity and elective shares. It also handles appeals of estate-related court decisions.

Those three grounds are the everyday currency of Florida probate disputes, and they work differently from each other. Undue influence claims turn on the relationship between the person who made the will and whoever benefited: who arranged the lawyer, who drove to the signing, who was in the room. Florida case law gives a presumption of undue influence when a substantial beneficiary held a confidential relationship with the decedent and actively procured the will, at which point the burden shifts.

Capacity claims run on different evidence. They look at what the person understood on the day of signing: the nature of their property, the people who would ordinarily inherit, and the effect of the document. Medical records and the testimony of witnesses to the signing carry most of the weight.

Elective share claims are arithmetic rather than argument. A surviving spouse in Florida can claim 30 percent of the elective estate whatever the will says, and much of the fight is over which assets belong in that pool.

How the team is built

Luis E. Barreto founded the firm and is its managing partner. He earned his law degree at the University of Miami Law School, and since 1992 he has concentrated on probate litigation, guardianship litigation, estate planning, and probate and guardianship administration. Before law he worked for a Fortune 500 company and served in the United States Coast Guard.

Four other attorneys appear on the site. Yuneymis "Yuni" Barreto is an associate attorney who took her law degree at Florida International University College of Law in 2015 and an LL.M. in Estate Planning from the University of Miami in 2019. She has been a member of the Florida Bar since 2016 and practises in estate planning and trust and estate matters. She was born and raised in Cuba and attended five years at the University of Havana, School of Law, before coming to the United States.

Luisa M. Linares has been a member of the Florida Bar since 1996 and has spent 21 years as a litigator, representing plaintiffs and defendants. She took her Bachelor's Degree at Columbia University and her Juris Doctorate at St. Thomas University School of Law. She has served as a Guardian ad Litem for neglected and abused children, which is court-appointed work on behalf of a child's interests.

Lily Wang-O'Brien holds an LL.M. from Northwestern University Pritzker School of Law, an M.S. in Cybersecurity Risk Management from Indiana University, and a J.D. from Indiana University Maurer School of Law. She also holds an LL.B. from Tunghai University in Taiwan. A Florida Bar member since 2023, she spent over a year in commercial litigation in Coral Gables.

Stephanie M. Miranda earned a Bachelor's degree in English from the University of Florida and her Juris Doctorate from Florida International University College of Law. During law school she worked as a judicial intern for the Honorable Judge Maria Korvick in the Probate Division at the Eleventh Judicial Circuit of Florida and completed over 130 hours of pro bono service.

Two paralegals, Alejandra Montealegre and Yaneisi Ledesma, appear in the site navigation. In my opinion the LL.M. in Estate Planning is the credential worth noticing here: it signals coursework past the J.D. in exactly the subject the firm sells.

What the record shows

The verifiable material on this firm is its people and its subject matter. Bar admission years, law schools and graduate degrees are published for the attorneys, and those are checkable against the Florida Bar. The founding year of 1998 comes from the firm's own account of itself.

Barreto's 1992 date for concentrating on probate and guardianship work predates the firm by six years, so the subject-matter experience runs longer than the letterhead. Linares brings 21 years of litigation across both sides of the courtroom. Two attorneys took their J.D. at Florida International University College of Law, which is a local pipeline.

Miranda's internship in the Probate Division of the Eleventh Judicial Circuit is a small detail with practical weight. The Eleventh Circuit covers Miami-Dade County, and it is where most of the firm's contested matters would be heard.

Language, access and reach

Lawyers and staff at the firm speak Spanish as well as English. For probate and guardianship work in Miami-Dade that matters in a concrete way. Clients in these matters are often elderly, often grieving, and asked to make decisions about money and medical care under time pressure. Doing that in a second language is hard.

The firm offers evening and weekend appointments, and meetings can take place at its Coral Gables office or at other South Florida locations. Guardianship and elder law clients are sometimes in hospitals, rehabilitation facilities or assisted living, so travel to the client has an obvious use.

How these matters usually run

Formal administration in Florida starts with a petition to the circuit court and the appointment of a personal representative. Creditors get a notice period. Assets are inventoried, debts and taxes paid, and the remainder distributed under court supervision. Uncontested estates can move through in months; a contested one takes considerably longer.

Guardianship follows a separate track. A petition to determine incapacity brings an examining committee, usually three members, who report to the court before a judge decides what rights the person loses and who exercises them. Guardianship litigation typically means a fight over who gets appointed or how an existing guardian is handling the money.

As a reviewer, the shape here is clear enough: a single-subject firm, five attorneys, one court system, two languages. The firm has worked this way since 1998.
