Focus and practice areas

The firm runs as a general practice, so one Worcester office covers eight named areas of law. Those areas are banking and commercial law, business and corporate law, criminal defense, family law, guardianships and conservatorships, litigation, real estate and land use, and trusts and estates with probate administration. The client base includes individuals, families and businesses across central Massachusetts.

The family law work covers divorce, separation and child custody. Real estate reaches residential and commercial transactions, along with disputes and development. These areas often connect in day to day work, because a property question can surface during a divorce and a family's main asset is frequently a home or a piece of land. A general practice like this one lets a client bring several kinds of problem to the same office over many years.

A Worcester practice with a long record

Mountain Dearborn traces its start in Worcester to 1887. The firm began with Willis E. Sibley. His brother Charles and Carl M. Blair joined in 1902, and the firm took the name Sibley, Sibley and Blair.

Three later arrivals built the name the firm carries now. Thomas R. Mountain came in 1948, Richard W. Dearborn in 1952 and Alfred N. Whiting in 1953. The firm dropped the Sibley name in 1965 and became Mountain, Dearborn and Whiting. It has held that name since, across several generations of Worcester lawyers.

How the team is built

The attorney roster splits into partners, of counsel and associates. The about page counts more than a dozen lawyers. As a reviewer, I find the attorney pages the most detailed part of the site, and most partners list their schools and the year they joined. The mix pairs tax depth with courtroom time, which fits a firm that handles both business files and disputes.

Partners and their backgrounds

Ann K. Molloy holds an A.B. from Mount Holyoke College, a J.D. from the University of Michigan and an LL.M. in taxation from Boston University. She clerked for a justice of the Minnesota Supreme Court and worked at a Minneapolis firm before she joined Mountain Dearborn in 1989. Francis J. Russell joined in 1981 and works in tax and business law, with probate litigation that reaches will contests and equity complaints involving trusts.

Katherine A. Bagdis earned an A.B. from the College of the Holy Cross and a J.D. from Suffolk University Law School, and she joined the firm in September 2010. Her work spans estate planning, divorce and family law, civil litigation, tax questions and real estate. Patricia Finnegan Gates has been with the firm since 2003 and counsels individuals and businesses on real estate, zoning and permitting, litigation, foreclosure and commercial transactions.

Robin A. DeAugustinis and Dale R. Harger both work in banking and commercial law, business and corporate law, and real estate and land use. Anthony J. Luzzo came to law after a finance and accounting degree from Bentley University and a J.D. from New England Law in Boston, and he built two of his own firms before this one. His practice now includes criminal work.

Of counsel and associates

Henry W. Beth practices of counsel, with a B.A. from Clark University and a J.D. from Boston University. His work covers corporate and incorporation matters, financial markets and services, and commercial real estate, and he has been counsel to the Town of Petersham. Ryan P. Donahue is an associate and a litigator who spent 2010 to 2016 as an Assistant District Attorney in Worcester County and handled felony and misdemeanor cases through trial in the District and Superior Courts. Stephen M. Roche also practices as an associate.

Business, banking and real estate work

The firm groups a set of related areas for companies and property owners: banking and commercial law, business and corporate law, and real estate and land use. DeAugustinis, Harger and Beth all work across this cluster. A company that forms, borrows and then buys or leases space can keep one firm through each of those steps.

Real estate here reaches residential and commercial transactions, disputes and development. Land use work touches zoning and permitting, which Gates handles alongside her litigation and foreclosure practice. A residential closing involves a purchase agreement, a title search and a recorded deed, and a lawyer checks each step before the sale completes. A development project in Massachusetts usually needs approval from a local board before construction, and that permitting stage is where a land use lawyer does much of the early work.

Estate, probate and family matters

Trusts and estates with probate administration is one of the firm's named areas, and it draws on the tax knowledge already on the roster. Estate planning covers wills, trusts and the documents that direct assets after death. Probate administration is the court process that settles an estate, and in Massachusetts it runs through the Probate and Family Court. Guardianships and conservatorships, also on the firm's list, let a court appoint someone to manage the affairs of a person who cannot do so alone. A conservator handles money and property, a guardian handles personal and medical decisions, and a court reviews both roles.

Family law shares that same court. Divorce, separation and child custody cases move through the Probate and Family Court, and the judges who hear estates often hear these files too. In a custody dispute, a Massachusetts court weighs the welfare of the child, which keeps these cases fact heavy and specific to each family. Bagdis and Russell both work in this area, and Gates adds property experience when a marital home or an investment is in play.

Criminal defense and courtroom work

Criminal defense is one of the eight practice areas, and two attorneys bring courtroom experience to it. Donahue prosecuted in Worcester County for six years before he moved to defense and civil litigation. Luzzo handled defense work at a Boston firm early in his career and now takes criminal matters as part of his practice.

A criminal case in Massachusetts moves through arraignment, pretrial hearings and, when it goes that far, trial in the District or Superior Court. A lawyer who has worked as a prosecutor knows how the other side builds a file. That experience is on the firm's roster, and a client facing charges can read it on the attorney pages.
